Your Rights

This section of the website wants to spell out what the 2 Housing and Homelessness Acts in Scotland say, and how these laws are carried out in Glasgow.

It should also help you to find the type of accommodation you need and want, by showing you what the Law says you can get!

The 2 recent laws in Scotland mean that Glasgow City Council has a legal duty to help you if you are:

  • homeless or rough sleeping, or
  • at risk of becoming homeless within the next two months.

This means that they MUST provide you with the accommodation and support you are entitled to, when you ask for it. This did not change when Glasgow transferred all its council houses to Glasgow Housing Association (GHA), because Glasgow City Council is still responsible for you if you are homeless.

The 2 new Laws were made to help you, but are complicated because they have to cover the different circumstances of everyone who is, or might become, homeless. This obviously includes many different types of people with different circumstances, and the Law decides which of these circumstances are a priority. The Law also instructs Glasgow City Council to make a decision on whether you actually are homeless, and other 'tests' to decide if you are in 'priority need' for accommodation.

So to find out what the Law says you are entitled to, you need to compare your own circumstances to the Law. This will let you work out what type of accommodation you are entitled to. And when you do get the type of accommodation you need, remember that there are many different types of organisations in Glasgow that will continue to support and help you if you need it.

The Law currently looks at four different issues when the council investigates homelessness, although they will be changing over the next few years. Use the links in the left hand menu to compare your circumstances against the 4 elements of homelessness law.
